1. Acceptance of Terms

By downloading, installing, or using any mobile application developed by Ever Assets LLC ("the App" or "our Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Apps for personal, non-commercial purposes, subject to these Terms and any applicable App Store terms.

3. User Responsibilities

You agree to:

  • Use the Apps in compliance with all applicable laws and regulations
  • Not attempt to reverse engineer, decompile, or disassemble the Apps
  • Not use the Apps for any illegal or unauthorized purpose
  • Not interfere with or disrupt the Apps or servers connected to the Apps
  • Not attempt to gain unauthorized access to any portion of the Apps

4. In-App Purchases and Subscriptions

Our Apps may offer in-app purchases or subscription services:

  • All purchases are processed through the Apple App Store and subject to Apple's terms and conditions
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your device's Settings
  • Refunds are handled by Apple in accordance with their refund policy
  • We reserve the right to modify pricing with notice to active subscribers

5. Intellectual Property

All content, features, and functionality of the Apps, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Ever Assets LLC and are protected by copyright, trademark, and other intellectual property laws.

6. Third-Party Services

Our Apps may integrate with third-party AI services or other external services. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the content, functionality, or practices of any third-party services.

7. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVER ASSETS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Apps
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Apps
  • Any bugs, viruses, or other harmful code that may be transmitted through the Apps
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content made available through the Apps

9. Indemnification

You agree to indemnify, defend, and hold harmless Ever Assets LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Apps or your violation of these Terms.

10. Changes to the Apps

We reserve the right to modify, suspend, or discontinue the Apps or any features within the Apps at any time without notice or liability.

11. Termination

We may terminate or suspend your access to the Apps immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Apps will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in the United States.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Apps after such modifications constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Ever Assets LLC regarding the use of the Apps and supersede all prior agreements and understandings, whether written or oral.
